At this point Kotax has ignited such a dumpster fire that she should simply back away and let the fire cool. Everything she and the dems do will keep the budget front and center in the voters minds. Which is a good thing. February 2nd is right around the corner, let's see how this session handles the heat.

What about Martin v Ervin, 80 Or App 555? Seems directly on point and says the repeal achieves the goal of the referendum and the referendum should be taken off the ballot?
I had read the case before writing but ended up not focusing on it because (a) it's local, not state, and I think there are differences btw the two in statute that I haven't dug into yet; and (b) the opinion says the referendum was filed after the ordinance's effective date, which was not the case w/transpo tax. Having said that, I'm sure whoever's arguing for nuking referendum from ballot will focus on this case, as they should. Thanks for bringing it back to my attn.
